Do you have any CCJ’s or being threatened with bailiffs?

(This information applies to England and Wales only)

Firstly contact the company and try and negotiate a set amount to pay weekly or monthly.

If the company don’t want to know they will need a warrant of execution from the courts before any bailiffs arrive to remove your property in payment of your debt. If they have a warrant already, you apply to the court yourself to have it suspended.

If you know that a threat of bailiffs is imminent, then lock your doors and windows and any side gates you may have. The reason for this is because you do not have to let the bailiffs in and they cannot force their way in. But, unfortunately, they are allowed into your property without your permission if they can enter without breaking in, e.g. getting through an open window, through a closed but unlocked door.

If they gain entry, any goods they take are not allowed to be basic clothing, furniture, bedding or household goods. Anything they do take will be sold at auction in order to pay off your debt.
